Direct Attorney Guidance for Cincinnati Green Card Applicants
Applying for lawful permanent residence from within the United States requires a strategy grounded in your eligibility, prior record, and available visa options. At The Fleischer Law Firm LLC, we guide Cincinnati applicants through each stage:
Our clients communicate directly and consistently with their attorneys rather than relying solely on an assistant or paralegal. We respond quickly and offer flexible scheduling, with ongoing communication in English or Spanish. Our firm has more than 40 years of immigration law experience, and Richard I. Fleischer has practiced U.S. immigration law since 1973.

Who May Apply for Adjustment of Status in Cincinnati?
Adjustment of status allows certain people already in the United States to apply for a green card without returning to their home country for consular processing. People who are lawfully present may be able to complete the process here, but eligibility depends on the facts of each case. Applicants living abroad generally use consular processing and become permanent residents after entering the United States at a port of entry with the appropriate immigrant visa.
Most green card matters we handle are based on family or employment. These cases generally require a U.S. employer, U.S. citizen family member, or lawful permanent resident family member to file an immigrant petition. Certain immigrant investors and people seeking a National Interest Waiver may be able to self-petition.
Most categories require an approved immigrant petition before filing Form I-485. Some permit concurrent filing, which means submitting the immigrant petition and Form I-485 together. Visa availability is generally required and is evaluated using the applicable Adjustment of Status Filing Charts and the Department of State Visa Bulletin.
Lawful entry doesn’t resolve every eligibility question. Unlawful entry, certain visa violations, and some criminal convictions can affect whether adjustment is available. We review the applicant’s classification, manner of entry, immigration history, and admissibility issues before recommending a filing strategy.
How the Cincinnati Adjustment of Status Process Works
The process typically begins when the applicant or sponsor files the appropriate petition. We determine whether a visa is available in the applicant’s category before moving to the green card application stage. We then assist eligible applicants in the United States with preparing and filing Form I-485 with U.S. Citizenship and Immigration Services (USCIS).
Biometrics Appointment
After USCIS accepts the filing, it generally sends an appointment notice for biometrics. At this appointment, USCIS may collect fingerprints, a photograph, or a signature for identity verification and background or security checks. We help clients understand the notice and prepare for this step.
USCIS Interview
USCIS determines whether an interview is necessary. Applicants scheduled for an interview must appear and answer questions under oath. Cincinnati-area applicants attend adjustment interviews at the USCIS Cincinnati Field Office.
We prepare clients by reviewing the application, supporting evidence, and questions that may arise from the case history. Applicants should bring the original documents requested in their notice, which may include passports, travel documents, and Form I-94 arrival and departure records.

Work, Travel & Case Updates While Form I-485 Is Pending
Some eligible adjustment applicants may request employment authorization by filing Form I-765 while Form I-485 remains pending. They may also request travel permission through Form I-131. When approved for this purpose, the travel document is commonly called Advance Parole, but filing or receiving it doesn’t make international travel risk-free in every case.
USCIS may issue a request for evidence when it needs additional documents or information. The response must be submitted by the deadline stated in the notice, or the officer may deny Form I-485. We evaluate the request and prepare a response based on the record and applicable immigration requirements.
Applicants can monitor a pending Form I-485 through the USCIS online case-status system or the USCIS Contact Center. Processing doesn’t follow one fixed timeline. The type of case, visa availability, interview requirements, evidence requests, and agency workload can all affect how long it remains pending.

Eligibility & Documentation Issues That Need Careful Review
Adjustment eligibility depends on more than having a qualifying sponsor. The applicant’s basis for filing, current visa availability, prior immigration history, and admissibility considerations must be assessed together. Family-based and employment-based cases may also require different sponsoring petitions and supporting records.
Important records to organize before filing include:
Identity and travel records: Passports, visas, entry documents, and available Form I-94 records.
Immigration filings: Prior petitions, applications, notices, and decisions from immigration agencies.
Category-specific evidence: Family relationship records, employment documentation, or evidence supporting an eligible self-petition.
Original records and consistent information across filings help USCIS evaluate an application. Differences involving names, dates, entries, employment, or family history may require an explanation and supporting evidence.
Changes after filing also deserve attention. A new address, change in family circumstances, employment development, or newly identified issue can require case-specific review while the application is pending. We help clients assess how those developments affect their filings and what action may be appropriate.
